What if Fidelity denies my claim?
Upon denial of your claim for recoupment of your Plan benefits, you may submit a separate claim for a benefit determination under the Plan’s Claims and Appeals Procedures under ERISA. The Plan’s claims procedures require you to first file a claim for recoupment of a Plan loss with Fidelity prior to commencing a claim under the Plan’s ERISA claim procedures.
