Top-Heavy Rules

Generally, under current tax law, if a plan provides more than 60% of its benefits to “key” employees, that plan is considered to be “top heavy.” Both “top-heavy” and “key” employees are terms defined in the Internal Revenue Code.

In the unlikely event that the Plan becomes top-heavy, you will be notified, your contributions may be adjusted, and your vesting may be accelerated to keep the Plan qualified under IRS regulations.

Effect of Being a Multiple Employer Plan
Since this Plan is a multiple employer plan, the Plan Administrator will apply the top-heavy rules separately to “related” Participating Employers within the same controlled group.
