If You Are on a Leave of Absence

If You Are on a Military Leave of Absence

Key Term
A Military Leave is an absence from employment with the Company due to the performance of duty, on a voluntary or involuntary basis, in a uniformed service of the United States, under competent authority and includes active duty, active duty for training, initial active duty for training, inactive duty training, full-time National Guard duty, and a period for which you are absent from a position of employment for the purpose of an examination to determine your fitness to perform any such duty. Under the Plan, you will not be treated as absent due to Military Leave unless:

  • You have given advance notice of your military service to the Plan Administrator;
  • The cumulative length of your absence and absence for prior Military Leaves from the Company does not exceed five years or such other period of time permitted by USERRA; and
  • You report to, or submit an application for reemployment to, the Company by the deadline imposed by the Company in accordance with USERRA.
