Loan Default

Your loan will be deemed to be in default if an installment payment is not made by the last day of the calendar quarter following the calendar quarter in which it is due. Also, if you request a distribution of your Plan Account, or a distribution is required to be made under the terms of a QDRO, before the loan is paid in full and the distribution amount includes any of the unpaid loan amount, the loan will be in default.

If you default on the loan and are not eligible for a distribution under the Plan, you will be deemed to have received a distribution of your outstanding loan balance. You will be subject to immediate income taxes and early distribution penalty taxes, if applicable. In order to take out any future loans, you would need to repay the deemed distribution, plus any interest, to the Plan. In addition, any subsequent loan would have to be made pursuant to an enforceable agreement indicating that payments will be made by payroll withholding.

If you default on a Plan loan and you are eligible for a distribution from your Plan Account in accordance with the terms of the Plan, your Plan Account will be reduced by the amount of the unpaid loan balance. This unpaid balance will be subject to income taxes and possibly a 10% early withdrawal penalty.
