If You Are on a Leave of Absence

If You Are on a Disability Leave

If you are temporarily disabled, your before-tax, catch-up, and after-tax contributions and the Company’s matching contributions and non-elective contributions will continue while you are receiving benefits from the Company’s short-term disability (“STD”) plan. While you are temporarily disabled, you will receive Continuous Service credit as described in Counting Hours of Service. The amount of your benefit from the STD Plan replaces the base salary component of the Eligible Pay on which the Company’s contribution to your profit sharing sub-account is based.

If you are receiving benefits from the Company’s LTD plan, you are considered to be on a Disability Leave, unless your Disability Leave ends under one of the terms described below, until the earliest of the dates described below:

  • You are no longer disabled under the Company’s LTD plan;
  • You die or otherwise terminate your employment with the Company; and
  • You receive or commence to receive a distribution under any defined benefit plan of the Sponsor or the Company.

While on a Disability Leave, you will receive Continuous Service credit as described in Counting Hours of Service for purposes of vesting until the earliest of the dates described above.

If you are on a Disability Leave as defined under the terms of the Plan, you will not be permitted to make before-tax, Roth, catch-up, or after-tax contributions and will not receive employer matching contributions or non-elective contributions. However, as long as you are on Disability Leave as defined under the terms of the Plan, you will continue to be eligible for profit sharing contributions to your profit sharing sub-account as long as you continue to receive LTD benefits from the Company. These profit sharing contributions are based on the same pay used to calculate your LTD benefit. You will be eligible for these contributions for as long as you are on Disability Leave.

Note that receiving benefits from the Company’s LTD Plan does not automatically mean you are on a Disability Leave as defined under the terms of the Plan. For example, you are receiving benefits from the Company’s LTD Plan through 2030, but your employment with the Company terminates as of December 31, 2025. You will receive in early 2026 any profit sharing contributions to which you are eligible that are attributable to the 2025 plan year. However, you will not be eligible for any profit sharing contributions attributable to the 2026 plan year and future years since you are no longer on a Disability Leave as defined under the terms of the Plan.

In addition, you may request a withdrawal of your Plan Account (minimum of $1,000) while you are disabled and receiving benefits from the Company’s LTD plan. Please refer to Disability Withdrawals for additional information.
